The Bombay High Court on Wednesday refused urgent hearing of a PIL against Maharashtra cabinet minister Nawab Malik, seeking to restrain him from commenting on officers of the Narcotics Control Bureau or its Zonal Director Sameer Wankhede.

The petition filed by a man claiming to be a businessman and maulana, was mentioned for urgent circulation before the bench of Chief Justice Dipankar Datta and Justice MS Karnik.

The court asked the petitioner to either wait till after the Diwali vacation or move the vacation bench. It further refused to grant liberty to move the vacation bench saying it would not encroach on the jurisdiction of any bench and asked the petitioner to satisfy the relevant bench.

Note: The petitioners have moved another precipice before the same bench.

The plea filed through Advocate Ashok Saraogi further seeks directions to Malik refrain from the commenting with an intention to demoralize the agency. And also not comment on the Zonal Director Sameer Wankhede and his family members.

“That this Hon’ble court be pleased to issue appropriate writ, order and direction, directing the Respondent No. 2 from in any manner commenting on the officer of the agency known as NBC and/or any other investigating agency with an intention to demoralize the said Agency including the Agency of the Narcotics Control Bureau and the officers and/or the family members of the said officer viz Sameer Wankhede in any manner whatsoever.”

The PIL claims that Malik has started a “war” against Wankhede and his sister.

It further alleges that Malik is making statement only to demoralize Wankhede and his team who is investigating the matter. “If a responsible Minister of the State of Maharashtra is permitted to openly criticize and defame such officers, obviously, their moral will go down. Also that the press cannot be unitized for demoralize an officer”, the plea reads.
